The Other Kind of IP

I was once told by an Electrical Engineer that his job was to produce paperwork. That is, in order for a product to successfully transition from an engineering to a manufacturing environment, it must be well documented. Producing video content is very similar to designing an electronic circuit. The fun part of the process is the design or the creation. To produce a truly professional piece, whether it be an electronic design or a movie, proper documentation is absolutely necessary and is as important as the creative process.

In video creation, this documentation includes obtaining clearances, location releases and other rights for all of the material used in a piece of content that is produced for distribution. Thomas Crowell was an award winning producer of children’s content before his career shift to a lawyer focused on entertainment law. Thomas recently spoke to the attendees at the Local Content Workshop regarding the things that independent telcos needs to be aware of when creating original video content.

The following is a brief snippet of Crowell’s presentation. In this clip, Crowell discusses the concept of “Fair Use” and provides some guidelines as to when content can be appropriated at no charge under “Fair Use” criteria.
